Acceptance of Terms

By using this website you agree to the website terms below. Use of Fiavaion's open-source software is governed by that software's licence, not by these terms — see Open-Source Software.

Who You Are Agreeing With

Fiavaion is not a registered company. It is the name under which one independent developer in Dublin, Ireland publishes this software and website, and these terms are with that individual. They are identifiable on written request to info@fiavaion.com. If Fiavaion is incorporated in future, this page will name the company and its registration number.

Our Software

All Fiavaion software is provided free of charge. We don't charge for downloads, usage, or features, and there is no paid tier. Development is funded entirely by voluntary community contributions through Patreon, Buy Me a Coffee and GitHub Sponsors.

Open-Source Software (EUPL-1.2)

AssisT, MultiMon and FiavaionDictate are released under the European Union Public Licence v1.2 (EUPL-1.2). The licence text that ships with each repository is the governing document; nothing on this page adds to it or takes away from it. Under the EUPL-1.2 you may:

  • Use the software for any purpose, personal, educational or commercial
  • Study and modify the source code
  • Redistribute the software, modified or unmodified, under the same licence (EUPL-1.2, or one of the compatible licences the EUPL itself lists)
  • Deploy it across an institution without asking our permission and without a fee

What the licence asks of you in return: keep the copyright and licence notices intact, state any changes you made, and license your redistributed version under the EUPL-1.2 or a licence the EUPL declares compatible. If you distribute a modified version, make the corresponding source available on the same terms.

"Fiavaion", "AssisT", "MultiMon" and the Fiavaion logos are used to identify the origin of the software. The EUPL does not grant trademark rights, so please don't present a modified build as the official one — rename it and say what you changed.

Website Use

These terms cover this website itself — its pages, documentation and downloads:

  • You may read, link to, and quote this documentation with attribution
  • Please don't attempt to disrupt the site, scrape it at a rate that degrades it for others, or use it to distribute malware
  • Site content is provided for information; we may change or remove pages at any time
  • We may update these terms from time to time. Continued use of the website after a change constitutes acceptance of the revised terms

No Warranty

Our software is provided "as is" without warranty of any kind, express or implied, as set out in Article 7 of the EUPL-1.2. We do our best to ensure quality and security, but we cannot guarantee that the software will be error-free or meet your specific needs. If you are deploying at institutional scale, evaluate it against your own requirements first — the adoption pack is there to help you do that.

Limitation of Liability

As set out in Article 8 of the EUPL-1.2, Fiavaion and its contributors shall not be liable for any damages arising from the use or inability to use our software, including but not limited to direct, indirect, incidental, or consequential damages. Nothing in these terms excludes liability that cannot lawfully be excluded.

Support

Support is provided on a best-effort basis and there is no service level agreement. What we do commit to is published in the support commitments for AssisT; MultiMon and FiavaionDictate are supported on a best-effort basis through GitHub issues, with no published commitments. Accessibility reports to accessibility@fiavaion.com are acknowledged within 5 working days.

Community Funding

Contributions through Patreon, Buy Me a Coffee and GitHub Sponsors are voluntary donations, not purchases. They do not buy a licence you did not already have — every Fiavaion product is free to everyone under the EUPL-1.2, supporter or not — and they do not entitle you to a specific outcome, feature or delivery date.

There is one supporter tier, and it carries two things:

  • A vote on the public roadmap. Every supporter's vote counts the same, whatever the amount contributed
  • Your name on the supporters page, if you want it there

A roadmap vote is a signal about priorities, not an order we are contractually bound to fill. If something turns out to be infeasible we will say so on the roadmap and explain why.

Governing Law

These website terms are governed by the laws of Ireland. The EUPL-1.2 sets out its own governing law and jurisdiction for the software itself, in Article 15.
